EvoMind - Terms of Service

1. AGREEMENT TO TERMS
By creating an account, accessing, or using the EvoMind API, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. THE SERVICE
EvoMind is a cloud-hosted, API-only content moderation service. It provides access to five moderation models: jailbreak detection, vulgar language, PII detection, scam detection, and harmful content detection. The service is accessed programmatically via API keys and is intended for developers building moderation into their own applications.

3. ACCOUNTS & API KEYS
- You must sign in with a Google account to use the service.
- API keys are personal to your account. You are responsible for keeping them secret and for all activity that occurs under them.
- You may not share, resell, or publicly expose your API keys.
- We may revoke API keys that we reasonably believe are compromised, misused, or associated with a violation of these terms.

4. CREDITS & BILLING
- New accounts receive 1,000 free credits once per person upon signup.
- After free credits are used, access continues on a usage-based, pay-as-you-go basis (currently Rs.100 for 10,000 requests).
- Credits do not expire.
- All purchases are final; we do not offer refunds.
- We may change pricing, but any changes will not apply retroactively to credits you have already purchased.

5. BETA SERVICE
EvoMind and all of its moderation models are currently in beta. During this period, moderation results may be imperfect, and we may change features, model behaviour, pricing, or policies as we work toward general availability. We will make reasonable efforts to communicate such changes through our website.

6. ACCEPTABLE USE
You agree not to use the EvoMind API for:
- Any illegal activities or content prohibited by applicable laws
- Attempting to reverse engineer, decompile, or extract the underlying models
- Reselling access to the service or sublicensing API keys
- Interfering with or disrupting the service, or circumventing any rate limits we apply
- Using the service in a way that violates the rights of others, including privacy rights

The service operates under rate limits to ensure fair use by all customers. Rate limits may apply to individual API keys and may be adjusted over time.

7. YOUR CONTENT
You are solely responsible for the content you submit to the EvoMind API for moderation and for any use you make of the moderation results. You confirm that you have the right to process any personal data you transmit to our API and that such processing complies with all applicable data protection and privacy laws, including obtaining any necessary consent before transmitting personal data.

8. ATTRIBUTION
No attribution is required. EvoMind is provided as a hosted, backend API service, and you may use it in your applications without displaying any credit or acknowledgement to Mistyoz AI.

9. MODERATION RESULTS
Moderation results are generated by AI models and are provided for reference only. They may contain errors or inaccuracies, and you are responsible for how you act on them. We do not guarantee that results are correct, complete, or suitable for any particular purpose.

10. TERMINATION
We may suspend or terminate your account, revoke your API keys, or restrict your access if we reasonably believe you have violated these terms, if continued use would harm the service or other users, or as required by law.

You may delete your account at any time from Settings in your dashboard. Deleting your account permanently removes your account, API keys, and any remaining wallet credits, which are forfeited and cannot be refunded.

11. INTELLECTUAL PROPERTY
The name "EvoMind," the "Mistyoz AI" name and marks, and the EvoMind service are owned by Mistyoz AI Private Limited. The EvoMind API is provided as a hosted service and is not distributed as a downloadable or redistributable product. Nothing in these terms grants you ownership of the service, the underlying models, or any of our marks.

12. DISCLAIMERS & LIMITATION OF LIABILITY
- As Is: The EvoMind API is provided "as is" and "as available" without warranties of accuracy, reliability, fitness for a particular purpose, or uninterrupted availability.
- No Liability: Mistyoz AI accepts no liability for any damages arising from your use of the service, including but not limited to direct, indirect, or consequential damages.
- Availability: We do not guarantee uptime and are not liable for downtime, latency, or service interruptions.
- User Responsibility: You are solely responsible for your use of the service and for how you act on moderation results.

13. CHANGES TO TERMS
We may update these Terms of Service to reflect changes in our services or legal requirements. Significant changes will be clearly communicated through our website. Your continued use of the service after changes constitutes acceptance of the updated terms.

14. GOVERNING LAW
These Terms of Service are governed by the laws of India. Mistyoz AI Private Limited is based in Hyderabad, Telangana, India. Any disputes arising from these terms will be resolved in accordance with Indian law.
